sedan?

    Ok so today I got a speeding ticket. I am not worried about the cost of the
    ticket, but more so the points. I am going to fight it, and hopefully get
    out. The cop listed my car as grey, it is silver, and also as a SDN, under
    type, i am assuming that her means sedan. Is a 2 door hatchback considered
    a sedan? Any tips for when i go to court? Should i even bother fighting
    this? I live in Pa

  2. If it's your first offense and it was not a horrible one (IE. Reckless
    driving) if you plead guilty (at court there will be many people there for
    the same thing, he asks for a plea one at a time, if you plead guilty
    typically you pay (and attend) driving school and they drop the ticket and
    points). If you plead not guilty that will be a touch more difficult
    because it will become your word against his, and they sometimes have
    camera's that record all the offense. The two saving graces might be a. he
    does not show up (You are released because you have the right to face your
    accuser (not done it but have had friends told me they've done it, so take
    with a grain of salt)) or b. he did not calibrate his radar gun that day
    (works if he shot you, if he tailed you that's pretty much out (again with
    the friends and salt)). So if I were you plead guilty go to driving school
    (Get a discount on your auto policy maybe) and move on while driving more
    defensively. The details about the car are negligible and won't make much
    difference to the judge as he probably got your VIN and license plate
    numbers and really that's all that matters unless it was a camera that got
    you.

    i was thinking that becasue he had my liscense it would show that the car
    is registered to a silver not grey car...i dont know. I dont think they do
    driving school in pa unless you get your liscense revoked. I do have one
    ticket for running a red light a little over 1 year ago

    details won't matter unless you are a lawyer or hire one. Some courts
    *might* let you out on the details if they think that you are paying
    the lawyer more than the fine would be. The judge will know what the
    lawyer cost you. I would not count on winning this if I was you.

    If you had more points where you could lose driving then the DA will
    deal in some cases depending on what happened.

  5. If that's your strategy, forget it, as they can amend these minor
    details in court. As long as the VIN on the ticket is correct, they have
    you dead to rights. Unless you have some evidence that the officer did
    not correctly gauge your speed, taking this to court is a waste of time.

    I appreciate you're in PA, but FWIW I have a colleague who received a ticket
    in MD and because the cop didn't show up to court, the charge was dropped.
    The same happened with my brother-in-law who also received a ticket in MD.
    I'd suggest going to court, and if possible wait until you know if your cop
    is there before deciding whether to plead guilty or not guilty.

    I was very nice to the cop and he was very nice to me, he even joked that I
    could get away with speeding on the interstate, but that he didnt tell me
    that. I am hoping that if he shows up he will reduce my ticket. This is my
    forst speedin ticket since I was 16, (that was 8 years ago) I did get on
    red light violation in oct '03. I also iasked the cop is he knew my dad
    and brother, who are correctional officers..he said no, but it was worth a
    try. Right now the worst case seniro is i have to pay the full fine and get
    points, this WILL happen if i plead guilty, but MAY happen if i take it to
    court, so i firgure that buy fighting it i have nothing to loose,
    espically as the court costs are already included in the ticket. THANKS
    for the HELP

    **Aside from the cop not showing up, I know that in Michigan sometimes
    people can plead to pay the fine but ask to avoid having points
    assessed to their licenses. It's up to the judge's discretion but it's
    a shot. What color it is or whether it's a hatchback or not isn't
    grounds for dismissal, if that's what your pushing for. I know I'd
    rather avoid the points.

  10. Actually, you do have more to lose, the court costs. I fought one ticket
    and got the fine reduced, but the court cost brought it right back up to
    the original amount. If the judge thinks your defense is frivolous, you
    may end up paying court costs on top of the original fine.

    The court costs are already included in the fine, the only extra cost is
    $6.
