Tucson n line gear problem

hi all ive just leased a 69 plate n line and from day one have had gear shift problems causing a juddering noise and slow acceleration /having contacted the dealership ive been told its a known fault and nothing can be done until a software fault has been developed ?
has anyone else had this problem and what was the outcome
